This “Privacy Policy” details the privacy policies and procedures of W BY HC LLC, and its affiliates and subsidiaries, (collectively “Hotel Collection”, “us”, “we” or “our”) in connection with the Wine by Hotel Collection website (www.wine.hotelcollection.com), the Hotel Collection mobile application, any other website or mobile application that we may control, own, host, or offer and which is linked to this Privacy Policy (the “Sites”) including Hotel Collection affiliated retail stores and related services (together with the Sites, the “Service”), and an individual rights as it pertains to his or her personal information.

Section 1 – Information We Collect
The personal information you may provide to us through the Service, directly, or otherwise includes:

C. Automatic Data Collection. We, along with some or all of our service providers may automatically collect certain information about you, your computer, and/or mobile device, including your activity and actions through or on the Sites, for instance:
D. Online Activity (non-exhaustive list): URLs and/or landing screens you viewed, time spent on a specific screen or page, your navigation paths between such screens or pages, access times, and duration of access.

Section 2 – How Hotel Collection Uses Your Personal Information
Your personal information may be used for the purposes detailed below and as may be otherwise described in this Privacy Policy or at the point of collection.
A. To Provide our Services to You.We may use your personal information to:
- provide, operate and improve our Service, such as to enable you to make purchases of scenting equipment, oils, accessories, lifestyle products and other products that we market for purchase on the Sites;
- create your account on our Service;
- maintain your account on our Service;
- communication with you regarding our Service, which may include you certain notices, alerts, and support and administrative messages;
- provide customer success support and maintenance for the Service.
B. Direct Marketing.If you are an existing client of Hotel Collection (e.g., you have previously placed an order with us), we may use certain Personal Data you provided to send marketing communications about Hotel Collection services or products, unless prohibited by applicable law (or unless you have opted out). In some instances, we may request your consent to send you promotional and/or marketing information. We also may use the information that you provide to us, as well as information from other Hotel Collection products or services, such as your use of Hotel Collection’s website and/or apps, to customize advertisements or other communications pertaining to our services and products that may be of interest to you. Such information for registered users may include data collected from your interactions with our websites or apps that are linked to your account. C. Research & Development (“R&D”).We may use your personal information for R&D purposes, which may including analysis of your data to improve our Service, Sites, and business.
D. Anonymous Data.We may create aggregated, de-identified, or other anonymous records from your personal information and other individuals whose personal information we collect. We make personal information into anonymous data by excluding information (e.g, your name) that makes the data personally identifiable to you. We may use this anonymous data and share it with third parties for business purposes such as improving our Service and marketing and promotional purposes of the business.
E. Interest Based Advertising.We may partner with third-party advertising firms and social media platforms to produce ads on our Service and related sites. Those businesses, entities, and/or individuals that provide services on our behalf, or assist us in our operations and logistics (e.g., order fulfillment, shipping, payment processing, customer support, hosting, analytics, email delivery, marketing, database management services, returns, and fraud prevention/mitigation).
C. Advertising Partners.Third-party advertising companies collect information about your activity on the Site and other online services to help us advertise our services, and/or use “hashed” client/customer lists that are shared for the purpose of delivering ads to similar users on their platforms.
D. Third-Party Platforms.Social media and other third-party platforms that you connect to the Service (e.g., using Instagram or Facebook to connect to our Service or site). Please be advised, that we do not control any third party’s use of your personal information.
E. The Public.Other users of the Service and the public, when you disclose personal information for public use. For example, you may be able to review a product that you purchased, and we will display your name along with your review. We do not control how other users or third parties use any personal information that you make available to them. Please be aware that any information you publicly post has the ability to be saved, cached, copied, captured (screen or photo), or stored elsewhere by others (e.g., Google, Yahoo, Bing) before you may have the opportunity to edit or remove it.
F. Professional advisors.Professional advisors (e.g., lawyers, accountants, auditors, and insurers) where necessary in the course of the professional services that they provide to us.
G. Authorities and Others.Law enforcement, government authorities, and private parties, if and when necessary to comply with the applicable law or for the compliance, fraud prevention, and safety purposes detailed above.

A. Accessing or Updating your Account Information.If you have registered for an account with us, you may review and update certain personal information in your account profile by logging into the account.
B. Opting-out of Marketing Communications.You may opt-out of marketing-related emails by following the opt-out or unsubscribe instructions located at the bottom of the email. You may continue to receive service-related and other non-marketing emails. If you receive marketing SMS messages from us, you may opt-out of receiving further marketing text messages from us by replying STOP to the SMS message.
C. Cookies.Most browsers will allow you to remove and/or block cookies from the websites you visit. To do this, follow the procedure detailed in your browser settings. For more details, see the “Your Choices” section of our Cookie Policy.
D. Advertising Choices.You may opt out of Interest Based advertising. See the “Your Choices” section of our Cookie Policy for more information.
E. Privacy Settings and Location Information.Users of our App can disable our access to their device’s precise geolocation in their mobile device settings.
F. Choosing not to Share Your Personal Information.If you fail to provide us with the information needed to provide you with our Service, we may not be able to furnish you with the Service or certain features of the Service. We will inform you of the necessary information you will need to provide to receive a Service at the point of request.
G. Third-party Platforms or Social Media Networks.If you choose to create an account through or connect the Service with another third-party platform, you may have the ability to limit the information that we may obtain from the third party at the time you log in to the Service using the third-party’s authentication service or when you link your account. You may also be able to adjust your settings through the third-party’s platform or service after you have connected your account.
Section 4 – Other Sites, Mobile Applications, & Services
The Sites may contain hyperlinks to other domains, websites, and online services operated by third parties. These hyperlinks are not an endorsement or representation that we are affiliated with any third party. Additionally, our content may be included on web pages or online services that are not associated with us. We do not control third-party websites or online services. As such, we are not responsible for any third-party’s actions. Other websites and services follow different procedures and policies pertaining to the collection, use, and sharing of your personal information. We encourage you to review the privacy policies of the other websites, platforms, and online services you use.
Section 5 – Shopify
Our online store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you. Your data is stored through Shopify’s data storage, databases and the general Shopify application. They store your data on a secure server behind a firewall.
Payment:
If you choose a direct payment gateway to complete your purchase, then Shopify stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted. All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers. Section 6 - Security Practices
The security of your personal information is of upmost importance to us. We employ and utilize a whole host of organizational, technical, and physical safeguards designed to protect the personal information we collect. However, their exists an inherent security risk in all internet and data technologies and as such we cannot guarantee the security of your personal information, in instances which may be beyond our control.

Hotel Collection is headquartered in the United States and may have service providers in other countries. Your personal information may be transferred to the United States or other locations outside of your state, province, country, or other governmental jurisdiction where privacy laws may not be as protective as those in your jurisdiction.
Section 8 - Age Of Consent
The Wine by Hotel Collection site is not intended for use by minors under twenty-one (21) years of age, and we do not knowingly collect information about minors through the Service. All other Services are not intended for use by minors under the age of sixteen (16). If we learn that we have collected personal information of a minor without the consent of the minor’s parent or guardian as required by law, we will delete it. By using this Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site (excluding minor dependents use of the Wine by Hotel Collection site to which parental consent shall have no force or effect).

We reserve the right to modify this Privacy Policy at any time. If we make material changes to this Privacy Policy, we will notify you by updating the date of this Privacy Policy and posting it on the Sites. If required by law we will also provide notification of changes in another way that we believe is reasonably likely to reach you, such as via e-mail or another manner through the Service.
Any modifications to this Privacy Policy will be effective upon our posting the modified version (or as otherwise indicated at the time of posting). How to exercise your California rights. You may exercise your California privacy rights described above as follows:
- Right to information, access, and deletion. In addition to the above detailed “Opt- Out” mechanism for deletion of your Personal Information, you can request to exercise your information, access, and deletion rights by emailing support@Hotel Collection.com. We reserve the right to confirm your California residence to process your requests and will need to confirm your identity to process your requests to exercise your information, access, or deletion rights. As part of this process, government identification may be required. Consistent with California law, you may designate an authorized agent to make a request on your behalf. In order to designate an authorized agent to make a request on your behalf, you must provide a valid power of attorney, the requester’s valid government-issued identification, and the authorized agent’s valid government-issued identification.
We cannot process your request (excluding your request to “Opt-Out” via the link above) if you do not provide us with sufficient detail to allow us to understand and respond to it.
- Request a list of third-party marketers. California’s “Shine the Light” law (California Civil Code § 1798.83) allows California residents to ask companies with whom they have formed a business relationship primarily for personal, family, or household purposes to provide certain information about the companies’ sharing of certain personal information with third parties for their direct marketing purposes during the preceding year (if any). - Blocking cookies in your browser. Most browsers let you remove or reject cookies, including cookies used for interest-based advertising. To do this, follow the instructions in your browser settings. Many browsers accept cookies by default until you change your settings. - Blocking advertising ID use in your mobile settings. Your mobile device settings may provide the functionality to limit the use of the advertising ID associated with your mobile device for interest-based advertising purposes.
- Using privacy plug-ins or browsers. You can block our websites from setting cookies used for interest-based ads by using a browser with privacy features, like Brave, or installing browser plugins like Privacy Badger, Ghostery, or uBlock Origin, and configuring them to block third-party cookies/trackers.
- Platform opt-outs. The following advertising partners offer opt-out features that let you opt out of the use of your information for interest-based advertising:

- Advertising industry opt-out tools. Some of our business partners that collect information about users’ activities on or through the Sites or Apps may be members of organizations or programs that provide choices to individuals regarding the use of their browsing behavior or mobile application usage for purposes of targeted advertising. You can use the following opt-out options to limit the use of your information for interest-based advertising by participating companies:

- European users may opt-out of receiving targeted advertising on websites through members of the European Interactive Digital Advertising Alliance by clicking here, selecting the user’s country, and then clicking “Choices” (or similarly titled link).
- Users of our Apps may opt-out of receiving targeted advertising in mobile apps through participating members of the Digital Advertising Alliance by installing the AppChoices mobile app, available here, and selecting the user’s choices.
- Please note that we also may work with companies that offer their own opt-out mechanisms and may not participate in the opt-out mechanisms that we linked above.
If you choose to opt out of targeted advertisements, you will still see advertisements online but they may not be relevant to you. Even if you do choose to opt-out, not all companies that serve online behavioral advertising are included in this list, so you may still receive some cookies and tailored advertisements from companies that are not listed.
